Welcome to Nodmobile! We are stoked to have you on board. These Terms of Service outline the rules for using our website and purchasing our travel eSIM data plans. We like to keep things chilled, but it is important to lay down the ground rules so everyone is on the same page.
By using our service, you agree to these terms. Let's get into it!
1. The Service
Nodmobile provides digital travel eSIM data plans. These plans give you access to mobile data in specific countries without the need for physical SIM cards.
- Availability: Our network partners strive for optimal uptime, but mobile networks can occasionally drop or experience local maintenance.
- Fair Use: Plans are strictly for personal travel use. We reserve the right to throttle or suspend accounts that use automated systems, tether excessively beyond standard fair use, or engage in illegal activities over the network.
2. Device Compatibility
Before purchasing an eSIM, it is your absolute responsibility to ensure your device is ready for the service:
- Your phone must be eSIM compatible.
- Your phone must be carrier-unlocked.
Nodmobile is not responsible for eSIMs purchased for incompatible or locked devices. We cannot issue refunds for user-end hardware restrictions.
3. Refunds & Cancellations (UK Consumer Rights)
We want you to be perfectly happy with your connectivity, and we fully respect your rights under the Consumer Rights Act 2015 regarding digital content.
- 14-Day Cooling-Off Period: Online customers have the right to cancel their order for a limited time even if the item is not faulty. You can request a refund if you let us know within 14 days of receiving your digital item that you want to cancel. For our eSIM products, this applies provided the digital plan has not been installed or activated.
- Waiver of Rights: Under UK law, specific rules apply to non-physical goods. The moment you scan the QR code or install the eSIM to your device, the service delivery has begun. By downloading or installing the profile, you acknowledge that you lose your right to cancel for a change of mind.
- Faulty Digital Content: Under the Consumer Rights Act 2015, digital products must be as described, fit for purpose, and of satisfactory quality. If your eSIM does not function as advertised, you can request a repair or replacement. If repair or replacement is not possible, you are entitled to request a partial price reduction proportional to the problem encountered. In certain cases, you may receive a full or partial refund if the service was not as described or fit for purpose. If the digital content causes damage to a device that belongs to you, and the damage would not have occurred if reasonable care and skill were exercised, you are entitled to a remedy.
4. Expiry and Usage
Your data bundle begins the moment it connects to a supported network at your destination.
- The package will automatically expire either when the allocated data limit is reached or when the time duration (e.g., 7 days, 30 days) ends - whichever comes first.
- Unused data does not roll over and cannot be transferred to another device or user once activated.
5. Limitation of Liability
Nodmobile acts as a digital service provider for global connectivity. We are not liable for:
- Loss of data, communication, or business opportunities due to network outages.
- Charges incurred on your primary home SIM card if you fail to configure your roaming settings correctly before traveling.
6. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
